End-user licence agreement
Copyright (c) 2026 Jerome Goddard II (W4IJG). All rights reserved.
Please read this agreement before installing or using OpenJSQ. By installing, copying or using OpenJSQ you agree to it. If you do not agree, do not install or use OpenJSQ.
1. Who This Agreement Is Between
This agreement is between you and Jerome Goddard II (W4IJG) ("the Author"). "OpenJSQ" means the OpenJSQ software in executable form, its installer, its documentation and any updates the Author provides. "You" means the person who installs or uses it, or the nonprofit organisation on whose behalf they do.
2. What You May Do
The Author grants you a free, non-exclusive, non-transferable, revocable licence to:
- a. install and use OpenJSQ on computers you own or control, for PERSONAL use, or for use by a NONPROFIT organisation such as an amateur radio club, an emergency communications group (for example ARES, RACES or similar), a school or a public-service event;
- b. use OpenJSQ to receive and decode signals whether or not you hold an amateur radio licence (see section 5 for transmitting); and
- c. give unmodified copies of the official OpenJSQ installer or ZIP to others, free of charge, provided that:
- the copy is complete and unchanged, including this agreement and the third-party licence notices in the "licenses" folder;
- you charge nothing for it beyond the cost of the medium (for example a USB stick at a hamfest);
- you do not bundle it with other software or present it in a way that suggests the Author endorses you or your product; and
- every recipient is bound by this agreement.
3. What You May Not Do
Except as section 4 allows or as the law allows despite this restriction, you may not:
- a. use OpenJSQ for any commercial purpose, including selling it, renting it, offering it as part of a paid product or service, or using it in the course of a for-profit business, without the Author's written permission;
- b. modify, adapt, translate or create derivative works of OpenJSQ;
- c. reverse engineer, decompile or disassemble OpenJSQ;
- d. remove or alter any copyright, licence or attribution notice; or
- e. use the OpenJSQ name or logo in a way that suggests the Author endorses you, your product or your service.
To ask about commercial use, contact the Author at http://www.openjsq.com/contact/.
4. Third-Party Components
OpenJSQ includes third-party libraries, among them the Qt framework and other libraries licensed under the GNU Lesser General Public License (LGPL). Those libraries are licensed to you under their own licences, listed in the "licenses" folder, and nothing in this agreement limits the rights those licences give you. In particular you may replace the LGPL libraries supplied with OpenJSQ with your own versions, and you may reverse engineer OpenJSQ only as far as necessary to debug such replacements. You may request the source code of those libraries at http://www.openjsq.com/contact/.
The OpenJSQ protocol specifications published at openjsq.com are made available under their own terms, which allow you to implement them. This agreement covers the OpenJSQ software, not those specifications.
5. Radio Regulations: Your Responsibility
- a. Transmitting with OpenJSQ requires a radio licence that permits it where you operate (in the United States, an FCC amateur radio licence under 47 CFR Part 97). You must not transmit with OpenJSQ unless you hold such a licence.
- b. You, as the station licensee and control operator, are solely responsible for every transmission your station makes, including those OpenJSQ makes automatically on your behalf: automatic answers, relaying or carrying messages for other stations, repeating messages, mail custody and delivery, acknowledgements and station identification.
- c. Features such as the automatic airtime limits, the relay forwarding allowance, the HF automatic-control sub-band rules, Net mode and Stop TX are software safeguards provided for convenience. They are not a guarantee that your station complies with any law or regulation, and you must not rely on them for compliance. Settings such as "Unlimited (I'm responsible)" or "No restriction" place full responsibility on you.
- d. You are responsible for configuring OpenJSQ, your radio and your interface equipment correctly, and for operating within your licence privileges, band plans, power limits and local rules.
6. Not For Life-Safety Use
OpenJSQ is experimental amateur radio software. Messages may be delayed, corrupted, lost or delivered to the wrong station, and automatic features may not behave as expected. DO NOT rely on OpenJSQ as your only means of communication in an emergency or in any situation where a failure could lead to death, personal injury, or property or environmental damage.
7. Privacy
OpenJSQ contains no advertising and makes no separate usage or crash reports. OpenJSQ contacts www.openjsq.com once when it starts (at most once a day) to learn whether a newer version exists. That request reveals your IP address and the OpenJSQ version, as any web request does. It sends no callsign, message or other data. We count these existing requests by day and app version to understand release adoption. Our statistics database stores those totals without IP addresses or installation identifiers; see the Privacy notice. The check can be turned off in Settings; if it is off, OpenJSQ makes no such connection. Apart from that check, OpenJSQ communicates only over the radio, TNC or network connections you configure. Diagnostic bundles are created only when you choose to create one; they contain recordings and logs of your station’s radio activity and settings, and it is your decision whether and to whom you send them. Remember that amateur radio transmissions are public and may be received and recorded by anyone.
8. Beta And Pre-Release Builds
The Author may provide beta or other pre-release builds of OpenJSQ. These are covered by this agreement, and in addition:
- a. a beta build may require a licence file issued to your callsign, may stop working on a date built into it, and may contain more defects than a public release;
- b. a licence file is personal to the callsign it names; you must not share, publish or transfer it, and the Author may decline to issue or renew one;
- c. section 2c (giving copies to others) does not apply to beta builds or licence files: do not redistribute them; and
- d. the Author may ask you for feedback or diagnostic bundles, but you are never required to provide them.
9. Updates
The Author may, but is not required to, provide updates. An update may change or remove features. This agreement applies to any update unless the update comes with a different agreement, in which case that agreement applies.
10. No Warranty
OPENJSQ IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE AUTHOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT OPENJSQ WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR COMPATIBLE WITH ANY RADIO, INTERFACE OR OTHER SOFTWARE.
11. Limitation Of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AUTHOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, MESSAGES, PROFITS OR GOODWILL, DAMAGE TO RADIO OR COMPUTER EQUIPMENT, INTERFERENCE, FINES, PENALTIES OR REGULATORY ACTION, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF OR INABILITY TO USE OPENJSQ, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AUTHOR'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR OPENJSQ, WHICH IS ZERO, OR TEN U.S. DOLLARS (US$10), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain warranties to be excluded or liability to be limited, so some of the above may not apply to you.
12. Indemnity
You agree to defend and hold the Author harmless from any claim, fine or penalty arising from transmissions made by your station, from your breach of this agreement, or from your violation of any law or regulation.
13. Termination
This licence ends automatically if you breach this agreement. You may end it at any time by uninstalling OpenJSQ and deleting all copies. When it ends, you must stop using OpenJSQ and delete all copies. Sections 4, 5, 6 and 10 through 16 survive termination.
14. Export
You must comply with all export and sanctions laws that apply to your use or transfer of OpenJSQ.
15. Governing Law
This agreement is governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules. Any dispute shall be brought in the state or federal courts located in Alabama, and you consent to their jurisdiction, unless the law of your country requires otherwise.
16. General
This agreement, together with the third-party licences in the "licenses" folder, is the entire agreement between you and the Author about OpenJSQ. If any part of it is held unenforceable, the rest remains in effect. The Author's failure to enforce any provision is not a waiver of it. You may not assign this agreement; the Author may. The Author may publish a revised version of this agreement; it applies to versions of OpenJSQ released with it.
